1. Overview
Duffel Technology Ltd offers a Cancel For Any Reason (“CFAR”) product to give you flexibility with your travel. CFAR enables you to cancel your flight for any reason, subject to the exclusions, within a period of time (“Valid Cancellation”) and receive a partial refund of the total cost of your flight (excluding any add-ons, such as baggage) at the time of purchase (“Refund”), subject to these terms and conditions.
CFAR is not insurance and is not intended to constitute an offer to insure. You will obtain travel insurance at your choice and you acknowledge that the CFAR does not take the place of such insurance. If Duffel becomes aware that you are claiming a refund under insurance, it will invalidate your Refund under CFAR.
2. Restrictions
The CFAR may only be purchased: (i) at the time of booking (it cannot be added after); (ii) for all passengers on the booking; and (iii) for all segments/legs on the booking. The passenger making the booking on behalf of other passengers agrees it has authorisation to act on behalf of all passengers and shall determine whether to exercise the CFAR or not. If you exercise the CFAR, all segments/legs shall be deemed cancelled.
The CFAR is only valid: (i) for the booking for which it was purchased i.e. it cannot be transferred to other bookings; (ii) if you have paid the booking in full; and (iii) if you have paid the CFAR fee in full, which you acknowledge is non-refundable.
3. Changes to your flight
The CFAR does not apply to any and all changes made to your flight purchase, including without limitation changes to dates, passengers or destinations, and you shall not be able to recover the costs of any such changes under the CFAR. If you change your flight and later cancel the changed flight, the CFAR will apply only to the cost of the original purchased flight.
4. Valid Cancellation
To receive a Refund, you must cancel your flight 24 hours prior to the time of your first scheduled flight departure. After this period of time has passed, the CFAR will expire and any cancellations to your flight will be subject to the rules imposed by the airline (for more information please visit the airline’s website).
5. How to activate CFAR
To make a Valid Cancellation, please contact the company with which you made the flight booking (“Merchant”), providing the following WHAT INFORMATION.
6. Refund
The Merchant will issue you the Refund once Duffel determines that your cancellation is a Valid Cancellation. The CFAR does not entitle you to a full refund of all costs of your trip e.g. your hotel or additional expenses or costs incurred by you other than the cost of the original flight purchase. The Refund only applies in respect of the original flight purchase to which the CFAR product is attached. The Refund will be subject to normal bank processing timelines.
7. Exclusions
The CFAR is intended to apply to voluntary cancellations by you. It does not apply to: (i) any cancellation of a flight by an airline for any reason; (ii) any cancellation by you for a force majeure event (including without limitation declaration of any emergency by the governmental authority in the destination, war or natural disaster, or a designation by the World Health Organization that the destination is at risk from COVID-19); and/or (iii) any voluntary cancellation requested by you directly with the airline. Your CFAR shall automatically expire in the event of the foregoing events, and you may only seek to recover the costs via any travel insurance you may have or directly with the airline under their rules, without Duffel’s involvement.
8. Governing law
These terms and conditions and any dispute or claim (including non-contractual disputes or claims) arising out of them, their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales, although, if you are an EEA Customer, this shall not deprive you of any mandatory consumer rights of the law of the EEA State in which you are resident. You and we both agree that the courts of England and Wales will have exclusive jurisdiction to resolve any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these terms and conditions or their subject matter or formation. However, if you are a UK Customer, you may choose the law and jurisdiction of Scotland or Northern Ireland if you live in those places and if you wish to do so. Also, if you are an EEA Customer, you may choose to resolve any such dispute or claim in the EEA State in which you are resident.
